Weingarten Rights
How many times have you heard the term "Weingarten Rights" and still don't know what they are? Has a member of management ever called you into a meeting onto which they wanted to discuss any of the following topics: absenteeism, accidents, compliance with work rules, damage to company property, drinking, drugs, falsification of records, fighting, insubordination, poor attitude, poor work performance, sabotage, slowdowns, tardies, theft, or violating safety rules?

To make it simple, ask yourself the following question:

Has a member of management ever called you into a meeting and asked you a question?

If so, a meeting known as an investigatory interview has actually taken place. Investigatory interviews occur when management questions an employee to obtain information and that employee has a reasonable belief that discipline may result from what he or she says.

The National Labor Relations Act gives employees rights to assistance from union representatives during investigatory interviews. These rights are known as Weingarten Rights.

FMLA
Did you know ... The Family Medical Leave Act provides workers with the ability to balance demands of the workplace with the needs of their families. While this is a federal law, with rights come responsibilities. You are responsible for requesting leaves, for following through with the health care provider and ultimately seeing that your FMLA leave is approved. You are responsible to maintain this right for future employees by making every effort not to abuse the policy.

Failure to cooperate with the company's legal requirements will result in a denied leave. It will count against your attendance and Union representatives may be unable to have the denial overturned.

Educating yourself on the right's and responsibilities is the best defense.
